M/Y Independence, Sharm el Sheik Travel Conditions

1. Travel contract

1.1 With the travel registration in accordance with the conditions of the advertisement the customer submits an obligatory offer for the conclusion of a travel contract with the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT.

The registration can be verbal, by telephone or in written form. The registering customer acts on behalf of himself and for all other participants specified in the registration and is responsible also for their obligation to the offer, provided the customer committed himself for this with an appropriate separate formal obligation.

On submission of a written travel confirmation by the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT to the customer, a binding travel contract for both contracting parties becomes effective.

In the case of a travel confirmation, which deviates from the original offer to the customer, then this is considered to be a new offer to the customer, which they must accept within a period of 3 days. For the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT this new offer is only binding within this period.

1.2 Special agreements, that do not correspond to the contents of these conditions or the service specifications require an expressly written confirmation by the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT.

2. Payment

2.1 On receipt of the written travel confirmation, 20% of the travel price becomes payable immediately, as pre-payment, with reference to the invoice number. The account number is included in the invoice and/or travel confirmation. The pre-payment will be deducted from the total travel price. Payments without indication of the invoice number are not valid.

2.2 The remainder of the travel price becomes due at the latest 28 days before the travel commencement date and is to be paid into the same account without request to pay (statement of the receipt of payment). For short term reservations - if the duration between booking date and travel date is less than 28 days- the travel price is to be paid in full to the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT at the latest 10 days before the travel commencement date  (statement of the receipt of payment).

2.3 If the down payment amount is not received immediately or within 10 days after date of the reservation confirmation and also not after request within the payment times as listed above, the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT is entitled, to cancel the contract and the reservation without notice. In this case the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT, will be entitled to claim compensation costs in accordance with section 6.

2.4 The safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS reserve the right, for booked journeys with own arrival, by incorrect payment, to send the travel documents back to the customer by cash-on-delivery.

In the event that the cash-on-delivery is not accepted, then this will be considered as a withdrawal from the travel contract according to section 6.

2.5 Unless full payment has been received, there is no requirement to provide any of the offered travel services.
