M/Y Independence, Sharm el Sheik
Travel Conditions

11. Liability
11.1 All claims have to be made
within one month after the contractually agreed end of journey, in written form
to the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER
AND MARKUS EBERT. After this period, claims can only be made if the traveler
was prevented from adherence to the time limit, due to factors other than their
own negligence.
11.2 Another travel agent at the
time of the conclusion of the travel contract is not authorized for the payment
of claims concerning guarantee and compensation.
11.3 The contractual liability of
the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND
MARKUS EBERT for material damage, e.g. not personal injury, is limited to the
threefold travel price, provided the damage is not caused deliberately or
negligently. The same applies, if the safari boat M/Y INDEPENDENCE, SHARM EL
SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT are responsible for damage
only due to default of a service provider.
11.4 Non-legal claims for
Compensation
The safari boat M/Y INDEPENDENCE,
SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT are not responsible
for any claims for compensation arising from damage to property due to
irresponsible action of the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK,
OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT. As support, the validity of the
threefold travel price applies. Otherwise, the legal regulations apply.
11.5 If International conventions
exist with regulations for service providers such as the safari boat M/Y
INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK JAHRSDÖRFER AND MARKUS EBERT with
reduced liability, the safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS
FRANK JAHRSDÖRFER AND MARKUS EBERT can rely on these in appropriate cases of
damage.
12. Participation Obligations
12.1 The traveler is bound to
inform the local travel management, of complaints, immediately. If possible,
they will provide a remedy. If the traveler culpably omits to inform the travel
management then any claim is not valid.
12.3 In case of luggage lost or
damaged during flights, the traveler has to make a loss advice (P.I.R.) to the
airline. The safari boat M/Y INDEPENDENCE, SHARM EL SHEIK, OWNERS FRANK
JAHRSDÖRFER AND MARKUS EBERT have no liability for such cases.
